2. Client-attorney privileged and confidential information
In accordance with Article 22 of the Advocacy Law and Article 10 of the Rules of Advocate’s Ethics, approved by the Reporting and Electoral Congress of Advocates of Ukraine on 9 June 2017 (as amended on 15 February 2019), the observance of the principle of confidentiality is an essential and fundamental precondition for a relationship of trust between an advocate (attorney) and their client. Without such trust, the proper provision of professional legal assistance, defence, and representation is not possible.
The preservation of confidentiality in respect of any information deemed to constitute attorney-client privilege or personal data protected under data protection legislation is both:
a right of the advocate in relation to any legal or natural person that may seek disclosure of such information, and
a duty owed to the client and to any individuals to whom such information relates.
The attorney-client privilege includes:
the fact that a person has sought legal assistance;
any information disclosed to or obtained by an advocate, law office, advocate association, advocate’s assistant, trainee, or any other employee in connection with the provision of professional legal assistance or a request therefor;
the content of any communication (including correspondence or other interactions, whether via electronic or other means) between an advocate (or their assistant or trainee) and a client or a person seeking legal assistance;
the content of any legal advice, consultations, explanations, documents, data, materials, objects, or information prepared, collected, obtained, or provided by an advocate, assistant, or trainee in connection with the provision of professional legal services or other forms of legal practice.
Disclosure of information constituting legal professional privilege is strictly prohibited under any circumstances, including unlawful attempts by investigative bodies or courts to compel an advocate to give testimony in respect of privileged matters.
